This Acceptable Use Policy ("AUP") sets out the rules that apply when you access or use the hiwacorp.com website (the "Site"), our creative services platforms ("The Labs" and "The Agency"), and any generative AI tools or outputs that we provide (collectively, the "Services"). By using our Services, you agree to comply with this AUP. If you do not agree with these rules, please do not use our Services.
This AUP is intended to protect our business, users and third parties from misuse of the Services. It complements our Terms and Conditions and Privacy Policy. We may update this AUP from time to time and will post the latest version on our Site.
1. Purpose and Allowed Use
You may use our Services to:
Learn about our products and services and communicate with us.
Request quotes, proposals and engage us for creative projects.
Upload project briefs, assets and information that you own or are authorised to use.
Use generative outputs (e.g., images, videos, voice overs) created through our Services for lawful internal or commercial purposes, provided you comply with all applicable laws and third‑party rights.
2. Prohibited Activities
You must not use the Services (including any AI models or generated content) for any unlawful, harmful or abusive purpose. Prohibited activities include, but are not limited to:
Illegal or harmful conduct. Do not use the Services to break any law, facilitate illegal activities or commit fraud. This includes creating or distributing content that promotes violence, terrorism, child sexual exploitation, discrimination or other unlawful acts.
Intellectual property infringement. Do not upload, share or distribute content that infringes or misappropriates the intellectual property rights or privacy rights of others. You must have permission to use any third‑party materials that you provide to us.
Harassment and offensive content. Do not engage in harassment, abuse, stalking, defamation, threats or hateful conduct toward any person. This includes posting or submitting content that is obscene, defamatory, discriminatory or otherwise inappropriate.
Malware, spam and interference. Do not distribute malware, viruses or any other harmful code, engage in phishing or spamming, or otherwise interfere with or disrupt the integrity or performance of the Services.
Unauthorised solicitation or advertising. Do not use the Services to advertise or sell products, solicit funds or send unsolicited commercial communications without our prior written consent.
Circumventing security or abuse of systems. Do not attempt to gain unauthorised access to the Services, bypass any security or authentication measures, probe, scan or test the vulnerability of our systems, or use any data scraping or extraction methods.
Misuse of generative AI. Do not use our AI tools or outputs to:
Generate illegal or harmful content, such as deepfakes, misinformation, defamation or content intended to deceive, manipulate or exploit others.
Train your own models without our permission or use our outputs to build or improve models that could compete with or harm our Services.
Input confidential or highly sensitive information (including personal data, financial records or proprietary code) into AI prompts. Tenable’s guidance on AI acceptable use emphasises that policies should clearly state what data employees or users can and cannot share with AI tools.
Rely solely on AI outputs for decisions that could have legal, financial or personal consequences without appropriate human review.
Impersonation and misrepresentation. Do not impersonate another person or organisation, or misrepresent your affiliation with any person, company or entity. Do not submit false or misleading information.
Violation of third‑party policies or laws. Do not use our Services in a way that violates the terms of third‑party platforms (e.g., social media terms) or applicable laws and regulations, including data protection and export control laws.
3. Data and Sensitive Information
Use caution when providing content or instructions to our AI tools. You should:
Avoid sharing personal data or confidential information about yourself or others unless necessary. Do not share content that includes personal health or financial information, or proprietary trade secrets.
Acknowledge that AI tools may process and generate outputs based on the prompts you provide; you remain responsible for ensuring that the information you submit does not violate privacy rights or confidentiality obligations.
Understand that all data classification rules apply: you must not upload or process data with our Services if you do not have authorisation to do so.
4. User Responsibilities
You are responsible for the content you provide and for using our Services in accordance with this AUP. In particular:
Content ownership. You must own or have permission to use all materials you submit. You retain ownership of your own content, but you grant us the rights necessary to provide the Services (as detailed in our Terms and Conditions).
Accuracy and compliance. You should verify the accuracy of AI‑generated outputs and ensure that your use of such outputs complies with applicable laws and regulations. AI tools may produce inaccurate or biased content; exercise judgement before relying on them.
Monitoring. We are not obliged to monitor all content submitted via the Services, but we reserve the right to remove or refuse to process any content that violates this AUP or applicable law. You must ensure your use complies with all local and international laws.
5. Consequences of Breach
If we reasonably believe that you have violated this AUP or any applicable law, we may take one or more of the following actions:
Issue a warning or request that you cease the offending conduct.
Remove or disable access to any content that violates this AUP.
Suspend or terminate your access to the Services, either temporarily or permanently.
Report the matter to the appropriate authorities or law enforcement.
Pursue legal remedies where necessary to protect our business, users and third parties.
Our determination of whether a violation has occurred is final and binding. We will not be liable for any loss or damage resulting from our enforcement of this AUP.
6. Reporting Violations
If you become aware of any content or conduct that you believe violates this AUP, please report it to us immediately at info@hiwacorp.com. Termly suggests that AUPs should provide a clear reporting mechanism so users can notify the company of potential breaches. When making a report, please include sufficient detail (e.g., location of the content, description of the behaviour) for us to investigate effectively.
7. Indemnity and Disclaimer
You agree to indemnify and hold harmless HIWACORP LTD, its directors and employees from any claims, damages or expenses arising from your use of the Services or any violation of this AUP. We provide the Services on an "as is" basis and, to the fullest extent permitted by law, exclude all warranties and liability in respect of user‑generated content. We are not responsible for monitoring user activity; however, we may report unlawful activities to the authorities.
8. Changes to this AUP
We may update this AUP from time to time to reflect changes in our Services or legal obligations. The latest version will always be available on our Site. If you continue to use the Services after changes are made, you are deemed to accept the updated AUP.
